Summary
El sistema español de protección legal de las personas con discapacidad basado en la limitación de su capacidad de obrar ha sido sustituido por un nuevo sistema de apoyos al ejercicio de la capacidad jurídica. El trabajo analiza la terminología adoptada y ofrece una visión general de las medidas de apoyo. La reforma da la prioridad a las soluciones basadas en la autonomía privada y refuerza algunas instituciones antes existentes, pero secundarias como la guarda de hecho y la curatela.
Abstract
Spanish legal system for disable people based in restricting their ability to act has recently change. The work firstly analyses the new terminology, and secondly offers a general overview of the institutions of support stated by the law. The new regulation of supports reinforce private autonomy and some existing -but secondary –institutions like the “facto guardian” or the “curatorship”.
